General terms and conditions for purchasing goods in the online store at vulgarspirit.com, operated by FutureMind s. r. o. These terms have been drawn up in accordance with the legal order of the Slovak Republic.

The supervisory authority is the Slovak Trade Inspection (Slovenská obchodná inšpekcia, SOI), SOI Inspectorate for the Košice Region, Vrátna 3, 040 01 Košice.
2. Introductory provisions and definitions
These general terms and conditions (hereinafter the "GTC") govern the rights and obligations of the contracting parties arising from a distance purchase contract concluded between the seller and the buyer, the subject of which is the purchase and sale of goods offered in the online storevulgarspirit.com.
The buyer is either a consumer or an entrepreneur. A consumer is a natural person who, when concluding and performing the contract, does not act within the scope of their business activity, employment or profession.
The legal relationships between the seller and the consumer are governed by these GTC, the Civil Code (Act No. 40/1964 Coll.), Act No. 250/2007 Coll. on consumer protection, and Act No. 108/2024 Coll. on consumer protection, which also governs distance contracts, as well as other generally binding legal regulations. In relation to an entrepreneur, the legal relationships are governed by the Commercial Code (Act No. 513/1991 Coll.).
4. Prices and payment terms
All prices of goods are stated in euros (EUR) and are final. The seller is not a VAT payer, so prices are stated without VAT and no VAT is added to them. Delivery costs may be added to the price of the goods; these are communicated to the buyer before the order is submitted.
The purchase price can be paid by the methods offered during the ordering process (for example, by payment card or another electronic method). Ownership of the goods passes to the buyer upon full payment of the purchase price and acceptance of the goods.
The tax document (invoice) is sent to the buyer electronically to their e-mail address.
5. Delivery terms
The goods are delivered through a contractual carrier to the address provided by the buyer, or by another method selected in the order. The delivery period and shipping price are stated during the ordering process before the order is submitted.
The seller will deliver the goods to the buyer as soon as possible, no later than 30 days from the conclusion of the contract, unless agreed otherwise. If the goods cannot be delivered within the stated period, the seller will inform the buyer accordingly.
The risk of damage to the goods passes to the buyer upon acceptance of the goods. Upon acceptance, the buyer is obliged to check the integrity of the shipment and, in the event of obvious damage, to report this fact to the carrier and the seller.
6. Withdrawal from the contract
The consumer is entitled, even without giving a reason, to withdraw from a distance contract within 14 days from the day of accepting the goods. The withdrawal period is deemed to have been observed if the notice of withdrawal was sent to the seller no later than on the last day of the period.
The consumer may withdraw from the contract by e-mail at hello@vulgarspirit.com or in writing at the seller's registered office address. In doing so, they may use the model withdrawal form, but this is not an obligation.
The consumer is obliged to return the goods no later than 14 days from the day of withdrawal. The direct costs of returning the goods are borne by the consumer. The seller will refund the consumer all payments received, including delivery costs (up to the amount of the cheapest delivery method offered), within 14 days from the day the notice of withdrawal is delivered, using the same means of payment that the consumer used. The seller is not obliged to refund the payments before the goods are delivered to them or before the consumer proves that the goods have been sent back.
The consumer is liable for any diminished value of the goods resulting from handling the goods beyond what is necessary to ascertain their characteristics and functionality.
The consumer may not withdraw from a contract whose subject is, in particular: the sale of goods made according to the consumer's specific requirements, goods made to measure, or goods intended specifically for a single consumer (for example, goods with a personalized print or with a unique QR sigil linked to the buyer's account); furthermore, the provision of digital content not supplied on a tangible medium, if its provision began with the consumer's express consent and the consumer declared that they had been informed of the loss of the right to withdraw from the contract.
7. Complaints procedure and liability for defects
The seller is liable for defects that the goods have upon acceptance by the buyer. For goods sold to a consumer, the statutory period for asserting liability for defects (warranty period) is 24 months, unless a special regulation provides otherwise. The period begins to run upon the buyer's acceptance of the goods.
Liability for defects does not apply to defects caused by normal wear and tear, improper use, failure to follow care instructions (for example, washing and care symbols), mechanical damage, or unauthorized intervention by the buyer.
A complaint may be lodged by e-mail at hello@vulgarspirit.com or in writing at the seller's registered office address. In the complaint, the buyer shall state the order number, a description of the defect, and the claim being asserted. The seller will issue the buyer a confirmation of the lodging of the complaint.
The seller or a person authorized by them will decide on the complaint immediately, or in complex cases within 3 working days. The complaint, including the remedy of the defect, will be handled without undue delay, no later than 30 days from the day it is lodged. After the futile expiry of this period, the consumer has the right to withdraw from the contract or the right to have the goods exchanged for new ones.
8. QR sigil, account and digital content
Some goods are linked to a unique QR sigil, which, upon first scan, is bound to the buyer's account and enables access to digital content (for example, a digital product passport, profile or leaderboard). This link is unique and, once activated, generally cannot be transferred to another person.
By creating an account, the buyer is responsible for the accuracy of the data provided and for the protection of their login credentials. The seller is entitled to restrict or cancel an account that violates these GTC or generally binding legal regulations, in particular in the event of misuse, the publication of unlawful content, or content infringing the rights of third parties.
Digital content is provided "as is". The seller is not liable for the temporary unavailability of digital functions caused by maintenance or circumstances beyond its control.
9. Alternative dispute resolution
The consumer has the right to contact the seller with a request for remedy if they are not satisfied with the way their complaint was handled or if they believe the seller has violated their rights. The request may be sent to hello@vulgarspirit.com.
If the seller responds to the request with a rejection or does not respond within 30 days of it being sent, the consumer has the right to submit a proposal to initiate alternative dispute resolution to an alternative dispute resolution entity under Act No. 391/2015 Coll. The competent entity is the Slovak Trade Inspection (Slovenská obchodná inšpekcia,soi.sk), or another authorized legal entity registered in the list maintained by the Ministry of Economy of the Slovak Republic.
To submit a proposal, the consumer may also use the online dispute resolution (ODR) platform available at https://ec.europa.eu/consumers/odr.
10. Protection of personal data
The seller processes the buyer's personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Act No. 18/2018 Coll. on personal data protection. Detailed information about the processing of personal data is set out in the Privacy and GDPR document available atvulgarspirit.com/gdpr.
11. Final provisions
These GTC take effect on the day of their publication and apply to orders created during their validity. The seller reserves the right to amend the GTC; an already concluded contract is governed by the version of the GTC in force at the time the order was submitted.
Legal relationships not regulated by these GTC are governed by the legal order of the Slovak Republic. If any provision of the GTC becomes invalid, the remaining provisions remain in force.
